Terms and Conditions
1. Introduction
These terms and conditions ("Agreement") apply to all services provided by JC Electrical Services unless otherwise agreed in writing.
2. Definitions

"Services" means the electrical services provided by JC Electrical Services, including installation, repair, and maintenance as outlined in our proposal, quotation, or any agreement made between us.

"We", "us", and "our" refer to JC Electrical Services providing the Services to you.

"You" and "your" refer to the customer requesting the Services.
-
"Customer's Equipment" refers to any equipment or material belonging to you or for which you request us to provide services.
3. Incorporation of Conditions

Any contract or agreement made between you and JC Electrical Services will be subject to these terms and conditions. No other terms proposed by you shall apply unless expressly agreed upon by us.

Any terms or conditions that may arise from past dealings or customs are excluded from this contract.

No amendments to these conditions will be valid unless made in writing and agreed upon by both parties.
4. Quotations & Prices

Our quotations provide an estimate for the services you wish to engage with. However, an order will only be considered binding once it is confirmed or accepted by us.

If, upon inspection, the requested work cannot be carried out as planned, we will notify you promptly and may suggest alternative solutions or provide options and costs for replacement materials or equipment.

Prices in quotations will remain fixed for orders placed within 14 days. After this period, any increase in costs for materials, labor, or overheads will result in an adjustment to the quoted price.

If you delay delivery or performance of services, you will be responsible for any additional costs incurred.

We will charge for all work carried out at your request, including exploratory work. Overtime charges may apply if required to meet deadlines.
5. Work on Site

We will require safe and clear access to the Customer’s Equipment and a safe work environment in compliance with Health and Safety legislation. Any failure to ensure safety and compliance will be the customer’s responsibility.

You agree to hold us harmless from any legal or regulatory costs or proceedings resulting from your failure to provide a safe work environment.
6. Payment Terms

Unless otherwise agreed, payment for services will be due upon completion of the work. We will issue an invoice, and payment must be made on the day of completion by Bank Transfer / Cash.

All payments must be made in Pounds Sterling.
7. Designs, Drawings, and Specifications
-
You are responsible for ensuring the accuracy of any designs, specifications, or data provided to us. We are not liable for any issues resulting from incorrect or incomplete information you supply.

You agree to indemnify us against any third-party claims arising from following your specifications.
8. Warranty
-
We will take reasonable care of your equipment while in our custody, and we will be liable for any loss or damage caused by our failure to do so, limited to the replacement value of the equipment.

We will ensure all work is carried out with reasonable skill and care, using materials that meet appropriate quality standards.

If you identify defects within 2 months of completing the work, we will rectify them at no extra cost, subject to the terms of this Agreement.

You are responsible for reinstalling, testing, and ensuring the proper functioning of the equipment once work is completed.
9. Transportation
-
If we are responsible for transporting your equipment, we will not be liable for damage during transit unless reported within 1 day of delivery.

The loading and unloading of goods are your responsibility and at your risk unless otherwise agreed.
10. Termination of Contract
-
We reserve the right to terminate this Agreement if you fail to meet your obligations or if you become insolvent, enter bankruptcy, or enter into any arrangement with creditors.

If terminated, we may remove our equipment from your premises, and you remain liable for any outstanding payments or work already completed.
11. Limitation of Liability
-
Our liability is limited to the total amount paid under this Agreement, or a maximum of £100,000, whichever is greater. We are not responsible for indirect or consequential losses, including loss of profits or business.
12. Force Majeure
-
We will not be liable for any failure to perform due to circumstances beyond our control, including natural disasters, weather, power disruptions, third-party actions, or industrial strikes.
13. Dispute Resolution

Any disputes regarding the Services will be referred to an independent expert, whose decision will be binding. The cost of this process will be agreed upon between both parties.
14. Assignment & Subcontracting
-
You may not assign your rights under this Agreement without our written consent. We may subcontract any part of the Services at our discretion.
15. Notices
-
Notices must be in writing and sent to the address provided in our quotation or invoice. We may communicate via electronic means (email or text) for convenience.
17. Waiver
-
Any failure by us to enforce any provision of this Agreement will not prevent us from doing so in the future.
18. Entire Agreement
-
This Agreement constitutes the entire understanding between us and supersedes any prior discussions or written communications relating to the Services.
19. Validity
-
If any provision of this Agreement is found to be invalid, the remainder of the Agreement will remain in full force and effect.
20. Governing Law
-
This Agreement is governed by the laws of England.
